Terms of Service

1. Introduction

Welcome to MediBear Life (the "App"), operated by Demo Labs Pty Ltd ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of MediBear Life, including our mobile applications and related services (collectively, the "Services").

By downloading, installing, or using MediBear Life, you agree to these Terms. If you do not agree, please discontinue use of the App.

2. Purpose of MediBear Life

MediBear Life helps you organize personal medications, schedules, and health records: dose reminders, adherence tracking, home-screen widgets, vitals charts, PDF export, and optional caregiver sharing.

Important: MediBear Life is not a medical device and does not provide diagnosis, treatment, or clinical advice. All content is for informational and organizational purposes only.

3. Eligibility

You must be at least 16 years old (or the legal age of digital consent in your country) to use MediBear Life. By using the App, you confirm that:

• You have the legal capacity to enter into this agreement
• All information you provide is true, accurate, and up to date
• You will use the App only for lawful personal purposes

4. Your Responsibilities

a. Accuracy

You are solely responsible for the accuracy of the medication and health information you enter into the App. Always consult a licensed healthcare professional before making medical decisions.

b. Reminders depend on your device

Reminders are delivered by your phone's notification system. Device settings such as Do Not Disturb, Focus modes, battery optimization, or disabled notifications can delay or prevent reminders. Do not rely on the App as your only safeguard for critical medication.

c. Secure usage

You must keep your device secure and protect any health or personal data stored locally in the App.

d. Lawful conduct

You agree not to misuse MediBear Life, including (but not limited to):

• Uploading content that is illegal, harmful, or infringes on others' rights
• Attempting to access our servers or APIs without authorization
• Reverse-engineering or reselling the App or its backend services
• Using the App for commercial purposes without written permission

5. Caregiver Sharing

If you enable the optional caregiver sharing feature:

• You choose what is shared and with whom, and you can stop sharing at any time
• Shared data is end-to-end encrypted; our servers store and forward only encrypted content they cannot read
• You are responsible for inviting only people you trust to see the health information you choose to share
• Invitees must also use the App in accordance with these Terms

6. Account and Data

MediBear Life operates without user accounts. All data (such as medication lists, vitals, and health records) is stored locally on your device.

• We do not maintain cloud backups or access your personal data
• If you delete the App or your local storage, your data is permanently deleted
• You have complete control and ownership of your health information

7. Intellectual Property

All intellectual property rights in MediBear Life, including the App design, code, text, graphics, and logos, are owned or licensed by Demo Labs Pty Ltd.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or create derivative works of MediBear Life without written permission.

8. Third-Party Services

MediBear Life integrates with a small number of trusted service providers:

• Apple App Store and Google Play: app distribution and subscription billing
• RevenueCat, Inc.: subscription receipt validation and entitlement management
• Railway Corp.: secure hosting for the caregiver sharing relay

Each third party processes data under strict contractual and technical safeguards consistent with GDPR and Australian Privacy Act standards. None of them receive your health data. See our Privacy Policy for details.

9. Disclaimers

a. No medical advice

MediBear Life is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your doctor or pharmacist regarding any medical condition or medication. Never disregard professional medical advice or delay seeking it because of information from this App.

b. Service availability

We strive for reliable operation but do not guarantee the App will always be uninterrupted or error-free. Online features (such as caregiver sharing) may be temporarily unavailable for maintenance, updates, or technical issues.

10. Limitation of Liability

To the maximum extent permitted by law:

• Demo Labs Pty Ltd and its affiliates are not liable for any indirect, incidental, or consequential damages arising from use or inability to use MediBear Life, including missed or delayed reminders
• Our total aggregate liability for any claim shall not exceed the greater of AUD $100 or the amount you paid for the subscription in the preceding 12 months

Note: Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Demo Labs Pty Ltd, its officers, employees, and partners from any claims, losses, or expenses arising from your use of MediBear Life or violation of these Terms.

12. Subscriptions and Payments

MediBear Life is free for your first 30 days. After the trial, continued use of the App requires a paid subscription (monthly or yearly).

• Payments are handled by app-store billing (Apple App Store or Google Play); prices are shown in the App before you subscribe
• Subscriptions auto-renew unless cancelled through your app store account at least 24 hours before the end of the current period
• Refunds are subject to the respective app store's policies
• We do not collect or store your payment details

13. Termination

We may suspend or terminate your access to MediBear Life at any time if:

• You breach these Terms
• You misuse the App in ways that harm others or our services
• We discontinue the service (with reasonable notice when possible)

Upon termination, your right to use MediBear Life ceases immediately. Locally stored data will remain on your device unless you delete the App.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. You agree to the exclusive jurisdiction of courts located in Melbourne, Australia.

For EU users: These Terms are subject to mandatory consumer protection laws under the GDPR framework.

15. Changes to These Terms

We may revise these Terms periodically to reflect new features, regulations, or best practices. The updated version will be posted on our website and within the App with a new effective date.

Continued use of MediBear Life after an update means you accept the revised Terms. If you do not agree to the changes, you should discontinue use of the App.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Demo Labs Pty Ltd regarding your use of MediBear Life.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

18. User Rights and Consumer Protection

Nothing in these Terms affects your statutory rights as a consumer under applicable law, including:

• Australian Consumer Law (ACL) guarantees and protections
• EU consumer protection rights under GDPR and the Consumer Rights Directive
• US state consumer protection laws where applicable

You always retain the right to seek legal remedies if the App does not meet reasonable expectations or if we fail to meet our obligations under consumer protection law.
